Terms of Service

Content held upon Free100Site server must be deemed suitable. We do not allow any adult content. Free100Site reserve the right to refuse any content that is deemed unsuitable by the Free100Site team. Any users storing or displaying unsuitable content may be suspended and will be asked to remove the content. Should the issue be unresolved, Free100Site obtain the right to remove some or all of the user's content from the server without back-up or notice and cancel the user's account. No refunds will be applicable where a user has contravened these terms.

You may not store more data in your account than your allotted server space. If you begin to run out of space, please consider upgrading your hosting package to prevent any issues.

Your server space and ftp account is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.

Free100Site are not responsible for the back-up of your websites, unless you have opted for our maintained website packages. It is recommended that you keep an independent backup of all data stored on your web space should it be required for restoring data. You are fully responsible for your content and data, unless you have opted for our maintained website packages.

Free100Site does not allow any torrent, warez and proxies plus any script or software that uses high server usage.

You may not run server processes (eg. talkers/
IRC Bots) from your web space.

We do not allow any proxy, torrent activity or anything malicious on your hosting account.

We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.

When your account is closed, all files (including web pages, etc.) will be deleted.

Limitation of FTP/Web Hosting Services
Although Free100Site may, at it's discretion, advertise "Unlimited Bandwidth" in regards there are several limitations applied. The sole purpose of these limitations are intended of unnecessary use of Free100Site services by any such User, which restricts system availability for other such Users. These limitations apply only to Hosting offered by Free100Site.

Bandwidth Restrictions
Although we may, at our discretion, advertise unlimited bandwidth, we reserve the right to inform you that you must transfer your website if an excessive amount of bandwidth is being used. If the request is not met within 5 days, we do reserve the right to remove the website from our system.

We reserve the right to amend and update these Terms and Conditions at any time without notice.

To protect your privacy we never distribute your name or e-mail address to any third parties without your full permission.

Users must not participate in any form of un-solicited bulk e-mailing or spam.

By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.

Bandwidth

Free100Site operates a fair use policy and therefore offers unrestricted use of bandwidth. However, should your bandwidth reach the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage. Whilst we will make every effort to avoid this, if it is necessary to do so, your account may be cancelled without refund.

Webspace

Free100Site operates a fair use policy and therefore offers unrestricted use of webspace, unless otherwise stated in the hosting package description. However, should your disk usage reach the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your disk space usage. Whilst we will make every effort to avoid this, if it is necessary to do so, your account may be cancelled without refund.

Web hosting from Free100Site is intended for serving websites and web applications. It should not be used for online storage purposes alone (i.e. all files should relate directly to the website being hosted).

Web Pages

Commercial use of web and ftp space is permitted.

You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law, or any other laws applicable within the United Kingdom.

You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).

We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Free100Site do not allow adult or illegal content on our servers.

Cancellation and Refunds

All annual packages must be paid for in full up
front, for 12 month periods at a time. Monthly packages are charged per month via PayPal Subscription. The period of commitment, and service period, are equivalent to the payment period. If you cancel your account within your service period then Free100Site will not make any refunds on any unused portions of your account. While we do not offer refunds for pro-rated service you have no obligation to continue using our service.

Free100Site reserves the right to cancel the service at any time.

Right to Cancel
Free100Site reserves the right to cancel Service for any reason without prior notice. Pre-paid service is non-refundable. Cancellations after the first of the 14 days of the month will be charged for that full month. User must notify Free100Site in writing or via the original email address used when signing up for service. Fees for any setup and monthly/annually services charges' placed by Free100Site are non-refundable.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Free100Site harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against Free100Site, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Free100Site against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Free100Site' server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from Free100Site' server.

Disclaimer

Free100Site will not be responsible for any damages your business may suffer, Free100Site makes no warranties of any kind, expressed or implied for services we provide. Free100Site disclaims any warrantor merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Free100Site and its employees.

Free100Site reserves the right to revise the above terms and conditions at any time.
